An Acorn Whistleblower Testifies In Court

Ms. MonCrief testified that in November 2007 Project Vote development director Karyn Gillette told her she had direct contact with the Obama campaign and had obtained their donor lists. "An Acorn Whistleblower Testifies In Court"

Acorn, the liberal "community organizing" group that claims it will deploy 15,000 get-out-the-vote workers on Election Day, can't stay out of the news.

The FBI is investigating its voter registration efforts in several states, amid allegations that almost a third of the 1.3 million cards it turned in are invalid. And yesterday, a former employee of Acorn testified in a Pennsylvania state court that the group's quality-control efforts were "minimal or nonexistent" and largely window dressing. Anita MonCrief also says that Acorn was given lists of potential donors by several Democratic presidential campaigns, including that of Barack Obama, to troll for contributions.

The Obama campaign denies it "has any ties" to Acorn, but Mr. Obama's ties are extensive. In 1992 he headed a registration effort for Project Vote, an Acorn partner at the time. He did so well that he was made a top trainer for Acorn's Chicago conferences. In 1995, he represented Acorn in a key case upholding the constitutionality of the new Motor Voter Act -- the first law passed by the Clinton administration -- which created the mandated, nationwide postcard voter registration system that Acorn workers are using to flood election offices with bogus registrations.

Ms. MonCrief testified that in November 2007 Project Vote development director Karyn Gillette told her she had direct contact with the Obama campaign and had obtained their donor lists. Ms. MonCrief also testified she was given a spreadsheet to use in cultivating Obama donors who had maxed out on donations to the candidate, but who could contribute to voter registration efforts.

Project Vote calls the allegation "absolutely false."

She says that when she had trouble with what appeared to be duplicate names on the list, Ms. Gillette told her she would talk with the Obama campaign and get a better version. Ms. MonCrief has given me copies of the donor lists she says were obtained from other Democratic campaigns, as well as the 2004 DNC donor lists.

In her testimony, Ms. MonCrief says she was upset by Acorn's "Muscle for Money" program, which she said intimidated businesses Acorn opposed into paying "protection" money in the form of grants. Acorn's Brian Kettering says the group only wants to change corporate behavior: "Acorn is proud of its corporate campaigns to stop abuses of working families."

Ms. MonCrief, 29, never expected to testify in a case brought by the state's Republican Party seeking the local Acorn affiliate's voter registration lists. An idealistic graduate of the University of Alabama, she joined Project Vote in 2005 because she thought it was empowering poor people. A strategic consultant for Acorn and a development associate with its Project Vote voter registration affiliate, Ms. MonCrief sat in on policy-making meetings with the national staff. She was fired early this year over personal expenses she had put on the group's credit card.

She says she became disillusioned because she saw that Acorn was run as the personal fiefdom of Wade Rathke, who founded the group in 1970 and ran it until he stepped down to take over its international operations this summer. Mr. Rathke's departure as head of Acorn came after revelations he'd employed his brother Dale for a decade while keeping from almost all of Acorn's board members the fact that Dale had embezzled over $1 million from the group a decade ago. (The embezzlement was confirmed to me by an Acorn official.)

"Anyone who questioned what was going on was viewed as the enemy," Ms. MonCrief told me. "Just like the mob, no one leaves Acorn happily." She believes the organization does some good but hopes its current leadership is replaced. She may not be alone.

Last August two of Acorn's eight dissident board members, Marcel Reed and Karen Inman, filed suit demanding access to financial records of Citizens Consulting Inc., the umbrella group through which most of Acorn's money flows. Ms. Inman told a news conference this month Mr. Rathke still exercises power over CCI and Acorn against the board's wishes. Bertha Lewis, the interim head of Acorn, told me Mr. Rathke has no ties to Acorn and that the dissident board members were "obsessed" and "confused."

According to public records, the IRS filed three tax liens totaling almost $1 million against Acorn this spring. Also this spring, CCI was paid $832,000 by the Obama campaign for get-out-the-vote efforts in key primary states. In filings with the Federal Election Commission, the Obama campaign listed the payments as "staging, sound, lighting," only correcting the filings after the Pittsburgh Tribune-Review revealed their true nature.

"Acorn needs a full forensic audit," Ms. MonCrief says, though she doesn't think that's likely. "Everyone wants to paper things over until later," she says. "But it may be too late to reform Acorn then." She strongly supports Barack Obama and hopes his allies can be helpful in cleaning up the group "after the heat of the election is gone."

Acorn's Mr. Kettering says the GOP lawsuit "is designed to suppress legitimate voters," and he says Ms. MonCrief isn't credible, given that she was fired for cause. Ms. MonCrief admits that she left after she began paying back some $3,000 in personal expenses she charged on an Acorn credit card. "I was very sorry, and I was paying it back," she says, but "suddenly Acorn decided that ... I had to go. Since then I have gotten warnings to 'back off' from people at Acorn."

Acorn insists it operates with strict quality controls, turning in, as required by law, all registration forms "even if the name on them was Donald Duck," as Wade Rathke told me two years ago. Acorn whistleblowers tell a different story.

"There's no quality control on purpose, no checks and balances," says Nate Toler, who worked until 2006 as the head organizer of an Acorn campaign against Wal-Mart in California. And Ms. MonCrief says it is longstanding practice to blame bogus registrations on lower-level employees who then often face criminal charges, a practice she says Acorn internally calls "throwing folks under the bus."

Gregory Hall, a former Acorn employee, says he was told on his very first day in 2006 to engage in deceptive fund-raising tactics. Mr. Hall has founded a group called Speaking Truth to Power to push for a full airing of Acorn's problems "so the group can heal itself from within."

To date, Mr. Obama has declined to criticize Acorn, telling reporters this month he is happy with his own get-out-the-vote efforts and that "we don't need Acorn's help." That may be true. But there is no denying his ties with Acorn helped turbocharge his political career.

Five Days of the Obama ACORN Connection: Day 3 - Day 3: Obama Funneled Grant Money To ACORN

"As the head of a left-wing activist organization, Barack Obama funneled tens of thousands of dollars to ACORN, allowing the group to engage in their controversial voter registration activities. Given ACORN's troubling involvement in the presidential election, Barack Obama owes the American people a complete explanation regarding the true nature of his relationship with the group."

The Facts:

· Barack Obama Funneled Grant Money To ACORN

· While Barack Obama Served On The Board Of Directors Of The Woods Fund, ACORN Received $190,000 In Grants From The Organization

· From 1993 To 2002, Barack Obama Served On The Board Of Directors For The Woods Fund

· The Woods Fund Is Described As Leftist

Barack Obama Funneled Grant Money To ACORN

While Serving On The Board Of Directors Of The Woods Fund, ACORN Received Thousands Of Dollars Of Grants From The Organization:

· Chicago ACORN Received Grants Of $45,000 (2000), $30,000 (2001), $45,000 (2001), $30,000 (2002), And $40,000 (2002) From The Woods Fund. (Donors Forum Website, ifs.donorsforum.org, Accessed 6/10/08)

Barack Obama Served On Boards That Funneled Money To ACORN. "Mr. Obama further expanded his list of allies by joining the boards of two well-known charities: the Woods Fund and the Joyce Foundation. These memberships have allowed him to help direct tens of millions of dollars in grants over the years to groups that championed the environment, campaign finance reform, gun control and other causes supported by the liberal network he was cultivating. Mr. Brazier's group, the Woodlawn Organization, received money, for instance, as did antipoverty groups with ties to organized labor like Chicago Acorn, whose endorsement Mr. Obama sought and won in his State Senate race." (Jo Becker and Christopher Drew, "Pragmatic Politics, Forged on the South Side," The New York Times, 5/11/08)

"The Leftist Woods Fund, A Major ACORN Fertilizer." "One outgrowth of Obama's "community organizer" days in the not-so-leafy urbs of Chicago was serving on the board for the leftist Woods Fund, a major ACORN fertilizer. ACORN is ripe for a pruning, and Obama may have barked up the wrong tree with this group." ("Leaf Mold: Obama's ACORN Tie Points To Seedy Past," The Oklahoman, 10/15/08)

Five Days of the Obama ACORN Connection: Day 1 - Deep Roots

Today, McCain-Palin 2008 campaign spokesman Ben Porritt released the following statement:

"While serving as the director of Project Vote, Barack Obama formed the roots of his political career alongside ACORN, which is currently under investigation in thirteen states for election fraud and is also under investigation by the FBI. As more information becomes clear about Obama's associations, Americans are realizing his decisions are made using a combination of poor judgment and blind ambition. It is imperative that Barack Obama fully disclose the specifics of his relationship with ACORN, allowing the American people to determine its merit in this contest."

The Facts

· Obama Started Working With ACORN In 1992, And Earlier This Year Said He Had Been Fighting Alongside ACORN His Entire Career
· Obama Worked As An Organizer For Project Vote, An ACORN Offshoot
· ACORN'S Website Lists Project Vote As An Allied Organization

As A Community Organizer, Obama Worked With ACORN

Obama: "I've been fighting alongside ACORN on issues you care about my entire career. Even before I was an elected official, when I ran Project Vote voter registration drive in Illinois, ACORN was smack dab in the middle of it, and we appreciate your work." (Barack Obama 2008 Website, Accessed 10/8/08)

Obama Started Working With ACORN In 1992. "What's more, Obama worked as executive director of ACORN's voter-registration arm, Project Vote, in 1992. Joined by two other community organizers on Chicago's South Side, Obama conducted the voter-registration drive that helped elect Carol Moseley-Braun to the Senate that year." (Editorial, "Is ACORN Stealing The Election?" Investor's Business Daily, 10/8/08)

"Obama Worked As An Organizer For Project Vote, An Acorn Offshoot." "Early in his career, Obama worked as an organizer for Project Vote, an ACORN offshoot, and represented ACORN in legal actions, according to various published reports, including Associated Press articles. ACORN's political action committee endorsed Obama in the primary." (David M. Brown, "Obama To Amend Report On $800,000 In Spending," Pittsburgh Tribune-Review, 8/22/08)

Time Magazine Described Project Vote As A "Non-Partisan Arm" Of ACORN. "David Leland [is] national director of Project Vote, a nonpartisan arm of the Association of Community Organizations for Reform Now (ACORN), which claims it has registered more than 50,000 voters in the Columbus area." (Karen Tumulty and Perry Bacon, "Fighting For Every Last Vote," Time Magazine, 10/18/04)

McCain-Palin Campaign Conference Call On Barack Obama's Ties To ACORN

We do think too that after an opportunity at the debate on Wednesday when Barack Obama was asked about it, he continued to create a fog around the issue, not taking the opportunity to publicly spell out his historic relationship with the ACORN organization and also had a wonderful opportunity to explain exactly in detail what his relationship was with the ACORN organization when they hired them and spent over $800,000 to make them a part of his campaign. We believe that these issues are important in a close election." -- Rick Davis

Today McCain-Palin 2008 held a press conference call with Rick Davis, McCain-Palin 2008 Campaign Manager, to discuss Barack Obama's association with ACORN and the nationwide investigation of ACORN's practices:

Rick Davis: "I just wanted to update everybody on our thinking of what's going on in the emerging scandal related to ACORN and the election cycle this year.

"Its been about a week since we last talked about this and I thinks it's important to note a couple of important events that have occurred. One, I had sent a letter to my counterpart on the Obama campaign, David Plouffe, to encourage him to join a group that we organized called the Honest and Open Election Committee headed by former Senators Danforth and Rudman in an effort to ensure that there is a total confidence level in the American public for these elections. We believe that these are important historical elections and nothing should mar the outcome, regardless of whether we win or lose. Nothing should mar the outcome of this election cycle. We have gotten little to no response back from the Obama campaign on this issue. In fact, the only real remarks that they've made publicly is when David Plouffe went out of his way to make a point that he just thinks this is a cynical ploy to somehow reduce voter turnout. I can't believe th at any effort in this area to ensure that we have coordination between his campaign and mine, between these big issues would be anything that would be considered a cynical ploy.

"But leaving that, since we last talked on this issue, there have been more media reports of an expanding investigation by the FBI. We were aware last time we spoke that they had raided offices in Nevada but, evidently, according to press reports, their interest now extends beyond Nevada into other states. We're aware that there have been activities in New Mexico by the FBI. But I guess in news reports that extends to many other states that they may be taking a look at. We don't know and haven't spoken to the FBI about their investigation, but it does confirm the concerns that we've seen on the state by state basis of rampant voter fraud as it relates to voter registrations that require some effort to look at them.

"We do think too that after an opportunity at the debate on Wednesday when Barack Obama was asked about it, he continued to create a fog around the issue, not taking the opportunity to publicly spell out his historic relationship with the ACORN organization and also had a wonderful opportunity to explain exactly in detail what his relationship was with the ACORN organization when they hired them and spent over $800,000 to make them a part of his campaign. We believe that these issues are important in a close election. We believe that many of these states that are under investigation have had historically close elections and could be very close again and that we should do nothing in this campaign or in the press to do anything other than to ensure that there's a total confidence level that on election day and, more importantly, the day after the election that people believe that they have had a fair and honest election and that the pe rson who they chose to be the next president of the United States does so without a cloud of suspicion that seems to right now hang over this election.

"It's pretty clear that Barack Obama decided not to use the opportunity this week to spell out what's going on with his relationship with ACORN. We talked about in the past how ACORN has been involved with him as far back as his tenure on the Woods Foundation. His comments on his website that he's fought along ACORN his entire career, his early training of ACORN employees and he did mention that the ACORN representation in a court suit with the federal government.

I don't understand. I mean unless they think that there is a problem with his relationship with ACORN, why they wouldn't just come clean and talk about these things. But, more importantly, I think it's worth noting that there's still many questions about the $800,000 that ACORN got from his campaign within this last year. We've put out a press release this week that touched on some of these issues that we asked for full disclosure of those funds. What did they go to? What w as the relationship with Citizen Services, Inc? And, what exactly was Citizen Services Inc's relationship with ACORN? They claim that virtually all this money was spent outside the ACORN organization. Can they prove that? Can they elaborate on that? Can they explain what it was spent for? I think that if they're going to use these kinds of excuses to diminish their obvious historical relationship with ACORN, that they owe it to the public and to the press to scourge whatever written communication that they have had with these organizations in order to establish confidence that there wasn't something more to it. Have they denied in fact that they have any ongoing relationship with ACORN? Just as recently as the financial bailout to date in the Senate this last month, Barack Obama actively supported a Senate plan to cut ACORN into a percentage of the profits that would be generated by a massive trillion dollar bailout as part of a failed negotiation attempt that Barack Obama a nd the Democratic leadership in Congress claimed was the deal that John McCain upset the applecart on. I think the American public are probably happy that that deal never transpired.

"We also have suggested that you know we examined exactly what voter registration activity was compiled by ACORN as a part of this relationship with the Barack Obama campaign. What did they do in turnout? What was the nature of the functions that they performed? And what did they get for the $800,000 that they spent on this? They claim that this money was used in the Ohio primary. We know how close Ohio has been in past elections. We know how few votes made up the difference in many of the most recent elections. In fact, I would remind everybody that in states in 2000- Florida, Iowa, New Hampshire, New Mexico, Oregon, and Wisconsin- all were within 1% that were decided the outcome of that election. And in 2004 again in Iowa, New Hampshire, New Mexico, and Wisconsin, the election was decided by just 1%. So, this issue I know sometimes to many people looks like, 'well there's just not all that many people involved in this process. Ther e aren't that many registrations you know that are going to affect the outcome.'

"First, we don't know how big the problem is. There has been very little reporting on this outside of some state investigative reports. So, I don't think anybody at this stage has any sense of how widespread the fraud has been. Obviously, federal investigators being involved in this indicate it has risen to the level of their attention.

"And two, it only takes a very little to undermine the public's credibility that these elections were honest, open, and fair and I think that is the number one issue that we believe to be at stake here. When John McCain gets elected president, we want to know that these were the most honest elections the American public would have confidence in. I think that the idea that we can just blow off these charges as David Plouffe did as a cynical attempt to distract us from the bigger issues of this campaign is also not appropriate when talking about the integrity of American elections. In fact, what is most amazing is the criticism that Senator McCaskill has made where she claimed that there wasn't any fraudulent voting, that people claim that this is a huge problem and instances of voter fraud and that it would be dismissed as easily. When she was the Missouri auditor, she reported multiple instances of fraud in their registration process in St. Louis, including 935 possible felonies. Seems to me she's changed her tune pretty significantly when she had a specific responsibility for administering fair elections in that state and now acting on behalf of Barack Obama campaign doesn't seem to think it's that important.

"I would finally say that from our perspective, what is truly amazing is how some in the media, including The New York Times has treated this where, for some reason, they believe that just 1% somehow should just be swept under the rug. One percent of fraud should be swept under the rug? We should have no fraud. We send observers to elections all around the world, and we hold ourselves out to be the gold standard in democracy and transparency and that idea that the 'paper of record' would believe that just 1% of fraud would somehow be tolerable is outrageous.

"I'd lastly like to say that on a couple of other issues, as far as coordination with the Obama campaign, I'd like to say that there are other complaints that have been filed against them on FEC disclosure issues. They seem to be of the opinion that whatever they do is fine that they don't have to apply the same standards of transparency to their campaign that we do. On the issue of transparency and publicly releasing all of their donations, I think it's incredible that now that we know that there were specific problems with their fundraising that the act of not disclosing contributors who donate individually $200 or less in a time when we have done that since day one from our campaign, that there's not more pressure and more scrutiny from the media as to why the Obama campaign hasn't done this. They have gotten acclaim both nationally and internationally about how sophisticated they've been with their internet, how successful they'v e been in being able to contact all these voters through that. It's clearly been the engine that's fueled their fantastic financial success in this campaign and the reason that they continue to be ahead of us in fundraising since Obama has broken his pact with the American people to take federal money and continues to raise money at these levels. Why hasn't he released his donors from day one? Why hasn't he released them since the complaints that have been filed with the FEC? And why hasn't he released them today in order to try and regain confidence in the transparency of this election?

"So, I think there's a broader issue here of what's going on inside the Obama campaign while these questions remain unanswered. Why they don't feel a need to clean these things up if they're not that big a deal. Why not just release the documentation on ACORN? Why not open themselves up to a discussion of what exactly happened with that $830,000? I think these issues continue to plague this election. I believe nothing is more important than the integrity of these elections and whoever is elected president, whether its Barack Obama or John McCain we want to know that we've had a safe, transparent, and clean election."

McCain-Palin Statement re: Obama Campaign's Letter to Attorney General Mukasey

Today, McCain-Palin 2008 Spokesman Ben Porritt issued the following statement in response to the Obama campaign's letter to Attorney General Michael Mukasey:

"After a week of shifting stories and clumsy corrections regarding Barack Obama's connections to ACORN, the Obama campaign resorted to their now-customary heavy handed tactic of attempting to criminalize political discourse. Today's outrageous letter to Attorney General Mukasey and Special Prosecutor Dannehy at the Justice Department asking for a special prosecutor to investigate Senator McCain and Governor Palin's public statements about ACORN's record of fraudulent voter registrations (including in this week's Presidential debate) is absurd. It is a typical time-worn Washington attempt to criminalize political differences. For someone who promises 'change,' it is certainly only more of the same.

"The letter's request that the Department of Justice investigate 'recent partisan Republican activities throughout the country' is almost a parody of the Obama campaign's attempt to intimidate their political opponents. In case Sen. Obama's lawyer did not notice, we are in the midst of a political campaign, not a coronation, and the alleged criminal activity he calls 'recent partisan Republican activities' are what the rest of us call campaign speeches and debates. All of this is unfortunately reminiscent of the Obama campaign's recent creation of a 'truth squad' of Missouri prosecutors and sheriffs to 'target' people who criticize Sen. Obama. Rest assured that, despite these threats, the McCain-Palin campaign will continue to address the serious issue of voter registration fraud by ACORN and other partisan groups, and compliance by states with the Help America Vote Act's requirement of matching new voter registrations with state data bases to preve nt voter fraud."

McCain-Palin 2008 on FBI's ACORN Investigation

Today, McCain-Palin 2008 campaign manager Rick Davis released the following statement in response to the FBI's investigation of ACORN:

"Given the fact the FBI has launched a nationwide investigation into the questionable voter registration practices of ACORN, it is imperative that Barack Obama's campaign cooperate fully with this important investigation. To date, in public announcements including last night's debate, Barack Obama has attempted to conceal and distort his and his campaign's relationship with a group that is currently engaging in systematic voter fraud. Barack Obama's campaign must fully disclose the true nature of his association with ACORN, including:

· The total disclosure of all funds, including $832,000 from Barack Obama's campaign to ACORN and ACORN affiliations like Citizens Services, Inc.

· Any and all information the Obama campaign has related to ACORN's database of registered voters compiled during this election cycle.

· The total disclosure of coordination between Barack Obama's campaign, ACORN, and ACORN affiliations over the entirety of this election cycle.

· The truth behind ACORN's hiring of get-out-the-vote workers on Barack Obama's behalf in Ohio during this election cycle.

"In the spirit of a fair election Barack Obama should assist in this process prior to Election Day."

CNN Reports On The Obama Campaign's Misleading ACORN Story

"Now, today I'm told that the Obama campaign is saying that we may have paid them some money for canvassing, but in earlier e-mails with the Obama campaign, they did say that they paid them $800,000, a subsidiary of ACORN in the primary to garner votes." -- CNN's Drew Griffin

CNN's "The Situation Room"
October 14, 2008

CNN's Wolf Blitzer: "I want you to be very precise, Drew, and just clarify for our viewers what we know about the relationship between the Obama campaign and ACORN specifically. Because there's been confusion out there."

CNN's Drew Griffin: "I think Brian Todd laid it out very well. Barack Obama goes back with this organization. It's a community organizing organization. He was a community organizer. They crossed paths back in Chicago, worked together, he trained some of them. As an attorney, he represented the ACORN group in a motor voter case in the State of Illinois. A case that he won. And in the primary campaign, Barack Obama's campaign gave $800,000 to a subsidiary of ACORN to go out and register to vote. Now, today I'm told that the Obama campaign is saying that we may have paid them some money for canvassing, but in earlier e-mails with the Obama campaign, they did say that they paid them $800,000, a subsidiary of ACORN in the primary to garner votes. But the Obama campaign is trying to say now is, look, we are not working with them in the general election. That was the primary, this is the general election and these problems that we're seeing su rfacing right now are in the general election therefore we're not connected with ACORN."

Blitzer: "But Drew, are they confirming that they weren't with what you are describing as a subsidiary of ACORN or some third party that in turn went ahead and subcontracted to ACORN?"

Griffin: "No, in earlier e-mails with the Obama campaign, our producer Kathleen Johnson specifically spelled that out with their people, Ben LaBolt in Chicago who said, look, yeah we did work with them, a subsidiary of ACORN back in the primary, but we are not working with them anymore. I also want to point out, you know we were talking about whether or not this is a nonpartisan group or not. I attended a volunteer rally with ACORN. I would say 50% of the people had on ACORN for Obama t-shirts. So to say that this group is non-partisan or not somehow connected or at least favorable towards the Obama campaign I don't think is accurate."

McCain-Palin 2008 Statement on ACORN's Letter

Today, McCain-Palin 2008 campaign manager Rick Davis released the following statement in response to ACORN's letter:

"Almost a month ago, the McCain-Palin campaign reached out to Barack Obama's campaign, the Democratic National Committee and state election officials in an effort to cooperate on potential Election Day problems, including voter fraud. To date, we have not received a response. Today, our campaign's Honest and Open Election Committee, chaired by former Senators John Danforth and Warren Rudman, re-proposed that invitation in an event at the National Press Club. Given the extensive relationship between Barack Obama and ACORN, our campaign also feels that Senator Obama has a responsibility to rein in ACORN's efforts and to work aggressively against wide-scale voter fraud. In addition, Senator McCain has reached out to Rep. John Conyers, Chairman of the Judiciary Committee, to reject reports on voter challenges based on home-foreclosures.

"If left uncorrected, these numerous investigations and accusations of voter fraud with ACORN could produce a nightmare scenario on Election Day. It is our hope that the Obama campaign joins us in our efforts to prevent voter fraud prior to Election Day."
